Expert Evidence & Quantification of Loss for Dispute Resolution

Whether you or your client are contemplating a dispute or are already in a dispute, we can work with you through the dispute resolution process to provide advice and/or expert evidence pursuant to CPR 35. We work on a wide range of disputes, including loss of profits, completion account disputes, warranty disputes, commercial agents, professional negligence claims and compulsory purchase orders. Our services include:

Expert reports (either for the claimant or defendant or single joint).

Advisory services to prepare not-for-disclosure and disclosable letters and reports to assist clients with negotiating a settlement.

Preliminary review of documents to identify the most significant aspects of the case and to highlight key areas for further investigation or key documents that should be requested.

Desktop reviews for smaller, less complex claims where we prepare not-for-disclosure letters identifying errors in the claim, lack of information in the documents suppled, inconsistencies in the claim, exaggeration or potential fraud and/or initial recalculation of the claim.

Loss of Chance: Residential Development Scheme (Liverpool Docks)

Calculation of potential losses from the Claimant’s claimed loss of a chance to build a larger residential scheme in the Liverpool Docks (Romal Capital (CO2) Limited v Peel L & P (Ports) Limited).

IRHP Mis-sale: Consequential Loss & Expert Witness (FCA Redress / Litigation)

Calculation of consequential loss arising from the mis-sale of Interest Rate Hedging Products (IRHP). Engagements have dealt with clients in the FCA Redress Scheme and in litigation. Geoff was an expert accounting witness in the Property Alliance Group v RBS (reported case) and the Wall v RBS cases, as well as in numerous others.

Flood Damage: Loss of Income for Licensed Premises

Acting as expert on behalf of a claimant (pub) for loss of income following a flood caused by a local water company.

Breach of Agency Agreement: Lost SIM Card Commissions

Quantification of lost commissions in relation to the breach of an agency agreement in respect of SIM cards registration and resultant commissions. Case involved analysis of data from millions of SIM cards over a 10 year period.

Water Damage: Lost Profits for Automotive Parts Manufacturer

Quantification of loss of profits to an automotive parts manufacturer following water damage caused by defective factory construction.
